CBD Changes for 2026
Federal Law Change
Congress passed the Farm Bil in 2018 which clarified the definition of hemp to include the entire plant, specifically the floral parts and cannabinoids derived from it. It was exempt from the definition of the controlled substance act (CSA). Since then, many products have been available including different dosage forms and types of CBD.
In the fall of 2025, the Continuing Appropriations and Extensions Act of 2026 (P.L. 119-37) changed the federal definition of hemp leading to a number of significant changes in the sale of CBD products. It significantly narrowed the definition and may effectively ban 95% of the available products. As of November 12, 2026, we will no longer be able to sell certain CBD products, and the amount of CBD in available products will be lower.
What will change?
- Delta-8 products will NO longer be available
- Most psychoactive hemp-derived products will effectively be banned and NO longer available
- The total THC limit is now 0.4 mg of total THC per container. Prior to the change, the limit was 3 mg of Delta-9 THC and not the total THC amount.
- Delta-9 THC is one of the psychoactive compounds in the hemp plant.

What is CBD?
CBD is a non-psychoactive cannabinoid. CBD also may have numerous benefits, such as anti-inflammatory and neuroprotective properties.
Cannabinoids are the chemicals that give the cannabis plant its medical and recreational properties. Among the 113 cannabinoids produced, THC and CBD are the most prevalent and the most well-understood. Most strains of marijuana sold today are cultivated with higher levels of THC. THC is known for its psychoactive properties and is the reason you feel “high” after ingesting marijuana. Since CBD is non-psychoactive, it will not produce a “high.”
The human body has an endocannabinoid system (ECS) that receives and translates signals from cannabinoids. It produces some cannabinoids of its own, which are called endocannabinoids. The ECS helps to regulate functions such as sleep, immune-system responses, and pain. CBD is thought to stimulate certain receptors to reduce pain, anxiety, and inflammation It stops the breakdown of anandamide a chemical often referred to as the bliss molecule in your brain. This allows anandamide to stay in your system longer, helping relieve pain and boost brain function CBD also regulates the production of inflammatory molecules called cytokines,thereby reducing inflammation and pain.
What is the Endocannabinoid System (ECS)?
The Endocannabinoid System (ECS) is responsible for maintaining balance, or homeostasis, and optimizing health across biological systems.
The ECS is a neurotransmitter system is made up of CB1 and CB2 receptors throughout the body. Its role is to keep things in the body functioning normally and to keep things in balance. These cell receptors are found in many locations, including the brain, spinal cord and immune system, which give the body instructions on what to do to function properly.
Plant derived cannabinoids (phytocannabinoids) help supplement our Endocannabinoid system when our bodies do not naturally make enough.

What are phytocannabinoids?
Phytocannabinoids are plant derived cannabinoids. The flower of the hemp plant contains many different phytocannabinoids. These are turned into hemp extract (commonly known as CBD), which work at the cannabinoid (CB) receptor sites.
What is the difference between CBD/Hemp and THC?
Hemp and marijuana are both part of the Cannabis sativa family. Hemp is federally legal and has low levels of THC (must be less than 0.4mg per container) while cannabis is not federally legal and has much higher levels of THC (5-35%).
Why would someone take Hemp extract oil products?
According to recent research, out of the 62 percent of people who use CBD to treat a medical condition, most use it to manage chronic pain,
arthritis and joint pain. It may also be used to reduce anxiety and help you sleep better.
What should I be looking for to ensure I’m purchasing a quality product?
Certificate of Analysis (CoA or C of A) - any reputable company will provide a third-party analysis that will detail what’s specifically in the bottle.
Check for Chemicals, Pesticides, and Dangerous Additives - You’ll want to make sure the CoA tests for microbes, herbicides, etc. Next to each of those names, look for the result of “ND” or “Not Detected.”
